1. Conditions of participation and organizer
1.1 All followers of the KWS Facebook page are entitled to participate. Employees of KWS SAAT SE & Co. KGaA and their relatives, employees of companies affiliated with KWS SAAT SE & Co. KGaA and their relatives, employees of companies affiliated with KWS SAAT SE & Co. KGaA and their relatives as well as young people under the age of 16 are excluded from participation.
1.2 The competition is organized by KWS Scandinavia A/S, Lysholt Allé 10, 7100 Vejle ("KWS"). All questions, comments or complaints regarding the competition should be addressed directly to KWS (social.media@kws.com) and not to Facebook.
1.3 The contest is not affiliated with Facebook and is in no way sponsored, supported or organized by Facebook.
1.4 In addition to these Terms of Participation, the relationship between KWS, the participants (hereinafter referred to as "participants") and Facebook is determined by the Terms of Use and the Privacy Policy of Facebook (https://www.facebook.com/legal/terms). Participants cannot assert any claims against Facebook that arise in connection with participation in the competition.
2. Participation
2.1 The Hybridrye Pricing lottery will take place from week 50, 2020 till January 15th, 2021.
2.2 The winner will be found on January 18th, 2021 and will be notified directly by email.
2.3 Participation in the lottery is free of charge for the participants.
2.4 Each participant is only entitled to enter the competition once.
2.5 KWS reserves the right to exclude persons from participation in the competition - even later - if these conditions of participation are violated and not to award prizes to them or to demand that they return them.
3. Prize
3.1 The winner is the participant who has been randomly selected by KWS from all participants ("winner").
3.2 KWS sets the following price: Weber® Q3200 gasgrill

3.4 A winner's claim to his prize is not transferable to any other person or company. The value of a prize cannot be paid out to a participant, another person or company.
4. Public announcement of the winners and notification by KWS
4.1 By participating in the competition, each participant irrevocably agrees that his/her username may be mentioned by KWS in connection with the announcement of the winners of the competition, especially on the KWS Facebook page.
4.2 If it is not possible to notify the winner or if the winner does not contact KWS within one week of sending the notification to hand over the prize, KWS is released from the obligation to perform.
5. Liability
5.1 The liability of KWS for damages incurred in connection with the execution of the contest or through winning the contest is limited to intent and gross negligence. In case of gross negligence KWS is only liable to the amount of the foreseeable, typically occurring damage. The aforementioned limitation of liability shall not apply in the event of breach of material contractual obligations, injury to life, limb and health and for claims based on the provisions of the Product Liability Act.
5.2 KWS is released from all obligations upon delivery of the prize. In particular, KWS shall not be liable for defects in the prize. Any claims by the participant relating to the prize must be addressed exclusively to KWS.
6. Privacy policy
We, KWS Scandinavia, Lysholt Allé 10, 7100 Vejle (hereinafter also referred to as "KWS", "we" or "us") organize contests from time to time, primarily for farmers. If you take part in these competitions, you will provide us with personal data. In this data protection declaration, we inform you about how we process this data.
6.1 What personal data do we process in the context of competitions?
For our competition we regularly process the names and postal addresses of participants. We have to process this data, because without this information we could not determine the winner and could not play the prize. We also regularly ask the participants whether they are interested in our e-mail service, with which we inform them about our products and send them specialist information. For this purpose, we ask for the e-mail address, the provision of which is voluntary.
6.2 For what purpose do we process the data?
We process your data with priority in order to determine the winner of the competition and play the prize. We also process your data to send you information about KWS and its products by post.
6.3 On what legal basis do we process your data?
The legal basis for the processing of your personal data is Article 6 paragraph 1 letter f) of the EU Data Protection Basic Regulation. Our legitimate interests lie in being able to determine the winners of the competition and to play the corresponding prizes, as well as to advertise our services to persons inter-ested in KWS products.
6.4 Do we pass on your data to third parties? Who is the recipient of your data?
We work together with internal and external service providers (so-called contractors), such as service providers for IT maintenance services. These service providers may only act in accordance with our instructions and are contractually obliged to comply with the applicable data protection requirements.
To the extent legally permissible and necessary to comply with applicable law or to assert, exercise or defend legal claims, we will disclose your personal data to courts, authorities, or law firms.
6.5 How long do we store your data?
If you participate in a KWS competition, we assume that you are interested in our services and products. We therefore retain your data until you inform us that we should delete your data or until the data is no longer required for the purpose we are pursuing. In the event of a request for deletion, we will delete your data immediately, provided that KWS is not allowed or required to store your data for a longer period of time for any other reason (e.g. due to another business contact).
6.6 What rights do you have?
Within the framework of the respective legal requirements, you have certain rights with regards to your personal data. Please note that certain exceptions apply to the exercise of these rights and that you may therefore not exercise them in all cases.
Information: You have the right to receive information on all personal data stored by KWS about you.
Correction: You can demand that we change incorrect personal data.
Deletion: You can request us to delete personal data under certain circumstances and we will take reasonable steps to inform other responsible persons who process the data that you have requested the deletion of links to your data, copies or duplications of your data.
Revocation of consent: You may revoke your consent to data processing that you have given us and prevent further processing if there is no other reason why KWS can or must process your personal data.
Restriction: In certain cases you can demand that we restrict the processing of your data.
Portability: If you have provided us with data on the basis of a contract or consent, you can demand that you receive the data you have provided in a structured, common, machine-readable format or that we transfer it to another person responsible.

You have the right to object at any time, for reasons arising from your particular situation, to the processing of your personal data on the basis of legitimate interests. This personal data will then no longer be processed for these purposes, unless compelling reasons for processing worthy of protection can be demonstrated which outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
Right to object to the processing of data for direct marketing purposes
In individual cases, your data will be processed for direct marketing purposes. You have the right to object at any time to the processing of your personal data for the purpose of such advertising. If you object to the processing for direct marketing purposes, your personal data will no longer be processed for these purposes.

7. Others
7.1 Legal action is excluded.
7.2 These Terms and Conditions of Participation and the entire legal relationship between the participants and KWS are subject exclusively to the laws of Denmark, excluding the conflict of law provisions.
7.3 Should individually provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation remains unaffected.
