Terms and Conditions

The Drone Giveaway (hereinafter the “Competition”) is promoted by KWS UK Limited, company number: 1578784, 56 Church Street, Thriplow, Royston, SG8 7RE (the “Promoter”). The address for correspondence with the Promoter is: 56 Church Street, Thriplow, Royston, SG8 7RE

1. Subject of the conditions of participation

These Terms and Conditions govern the course of the contest the Competition as well as the awarding of prizes within the framework of the Competition.

2. Eligibility

To enter the Competition, you must satisfy all the following conditions:

2.1 Be over 18 years of age.

2.2 Complete the KWS Marketing Survey.


3. Participation

3.1 Participation in the competition is only possible by fulfilling the requirements outlined in 2.2.

3.2 Each participant is only entitled to participate in the competition once and only one (1) prize is possible per participant.

3.3 Participation in the competition is free of charge. The purchase of products and/or services from the Promoter does not affect the outcome of the competition.

3.4 A violation of these conditions of participation entitles the Promoter to exclude the participant from participation – even retrospectively. This applies in particular if the participant makes untrue statements. If the excluded participant is a selected winner, the prize can be revoked retrospectively.


4. Prizes

4.1 One winner will be randomly selected from all those who have completed the survey. The winner will be given a drone, provided by the Promoter.

4.2 There is no claim to identity between the prize shown in the competition and the prize actually won. The Promoter reserves the right, if necessary, to replace the prize with a price of equal or higher value to the item presented as the prize. Each of the prizes available is of nearest equivalent value in price.

4.3 A winner's entitlement to their prize is not transferable to any other natural person or entity. A payment of the value of a prize to a participant, another person or company is excluded as well as the exchange of a prize.

4.4 There is no cash alternative for the prize.

4.5 Mislaid, late, lost, incomplete or corrupt entries or entries not fulfilling all the conditions of above will not be accepted regardless of cause, including, for example, network server failure, or computer hardware or software failure. Proof of despatch will not be accepted as proof of receipt.

4.6 The winner agrees to the use of his/her name, quotes, videos and images in any publicity material. Any personal data relating to the winner, or any other entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.


5. Notification and handover of prizes

5.1 The competition will close on the 31st December 2023. The winner will be notified by in the first instance by email on the 8th January 2024. The handover / execution of the prize will be individually coordinated with the respective winner.

5.2 With the handover / delivery of the prize to the respective winner, The Promoter shall be released from the obligation to perform.

5.3 The Promoter reserves the right to offer the prize to the next eligible applicant if within 10 days of the announcement date the winner cannot be contacted via email; or has not confirmed acceptance of the prize in response to an email; or has not provided a postal address for delivery of the prize


6. Liability

6.1 Unless otherwise stated in the following provisions, the Promoter shall be liable in accordance with the statutory provisions for damages incurred in connection with the execution of the competition and/or by winning the competition.

6.2 The Promoter shall be liable for damages – regardless of the legal grounds – within the scope of fault liability in the event of intent and gross negligence. In the event of simple negligence, the Promoters shall only be liable, subject to a milder standard of liability in accordance with statutory provisions, for damages alike from injury to life, limb or health, and for damages a not insignificant breach of an essential contractual obligation, i.e. an obligation the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner regularly relies and may rely. However, The Promoter’s liability for damages resulting from the not insignificant breach of an essential contractual obligation is limited to compensation for the foreseeable, typically occurring damage.

6.3 The Promoter shall be released from all obligations upon handover / handing over of the prizes. In particular, the Promoters are not liable for defects in profits. Any claims of the participant relating to the prizes are to be addressed exclusively to The Promoter.

6.4 The participant indemnified The Promoter from all claims of third parties asserted by them on the grounds that KWS' use of the video submitted by the participant violates their rights.


7. Data Protection

• The participants personal information, and the personal information of the person nominated to win the gift will be used by KWS for the purpose of this Competition and may be passed on to third party suppliers as required for fulfilment/delivery/arrangement of the prize.

8. Early termination of the competition

The Promoter reserves the right to cancel or terminate the competition at any time without prior notice. The Promoter makes use of this option in particular if, for technical reasons (e.g viruses in computer systems, manipulation or errors in the hardware/software) or for legal reasons, a proper execution of the competition cannot be guaranteed. The Promoter also reserves the right to assert all rights, in particular the claim for damages from participants who have caused the premature termination of the competition through their conduct – be it technical or legal


9. Miscellaneous

9.1 Legal recourse for disputes concerning the choice of the winner is excluded.

9.2 These terms and conditions shall be governed by the laws of England & Wales, and the parties submit to the jurisdiction of the courts of England and Wales.

9.3 Should individual provisions of the Conditions of Participation be or become invalid, the validity of the remaining Conditions of Participation shall remain unaffected.

9.4 By submitting an entry to the Competition, you are agreeing to be bound by these terms and conditions.
