KWS SAAT AG: Publication in accordance with § 26 (1) WpHG

We hereby inform you that, in accordance with § 21 (1) WpHG, on October 7, 2010 we acquired our own voting rights in KWS SAAT AG (ISIN: DE0007074007) of 0.1166% (7,700 votes).
Including mutual allocations, in accordance with § 22 WpHG, our total voting rights share exceeded the thresholds of 3%, 5%, 10%, 15%, 20%, 25%, 30% and 50%, and amounts to 56.097% (3,702,415 votes). In accordance with § 22 (2) sentence 1.1 WpHG, Alt., voting rights of 50.9792% (3,364,630 votes) and voting rights of 5.0012%, pursuant to § 22 (2) sentence 1.2 Alt. WpHG (330,085 votes) are attributable to us.
The following shareholders, whose voting rights in KWS SAAT AG are each 3% or more, are assigned voting rights:
