3. For what purposes and on what legal basis do we process your data?

We process your personal data within the context of our Facebook company profile for the following purposes:

a) Contact and interaction via Facebook

We process your personal data when you contact us through our company profile by using the Facebook functions provided for this (e.g. news, comment function, contributions or the “like-button”) or the contents provided by us (e.g. videos).

If you contact us in this way, we process your personal data that can be viewed directly in this context (usually: user name, profile image, message contents, including photos, date and time of the interaction) to respond to your contact. We also process personal data from you for the purposes of our public image as well as for information about and optimization of our products, services, and projects.

The legal basis for the processing is Article 6 (1) letter f) of the EU General Data Protection Regulation. Our legitimate interest lies in contacting (potential) customers and interested parties, the public image of our company, and to inform you about our products, services and projects.

The legal basis for the processing of your personal data is Article 6 (1) Letter b) of the EU General Data Protection Regulation, provided that your contact with us via Facebook is for the purposes of concluding or executing a contract.

b) Analyses for statistical purposes using page Insights on Facebook

We use Facebook’s Insights for the purposes of targeted designing and continuous optimization of our offerings on our Facebook company profile. For every visit to or interaction with our company profile, we receive anonymized information about our visitors from Facebook and their interaction with our company profile in the form of statistics (page Insights).

The processing in this respect takes place in joint controllership with Facebook pursuant to Art. 26 of the GDPR. We process the data using page Insights for the purposes of optimizing our offerings and ensuring more effective communication with (potential) customers and interested parties.

The legal basis for the processing of your personal data is Article 6 (1) letter f) of the EU General Data Protection Regulation. Our legitimate interest lies in the improvement of our offerings on Facebook.

c) Carrying out contests

If you participate in one of our contests, we will process your data in order to carry out the respective contest. The purpose of processing the personal data is to determine and announce the winner(s) and distribute the prizes. For this purpose, the Facebook names of those who participate in the contest are saved, and the winners are selected from them. Then, KWS announces the winners and contacts them in order to obtain their postal address and send the prizes.

The legal basis for the processing of your personal data is Article 6 (1) letter f) of the EU General Data Protection Regulation. The legitimate interest of KWS lies in being able to determine and announce the winner(s) of the contest and distribute the prizes.

4. Does KWS forward your data to third parties? Who are the recipients of your data and do they reside in third countries?

The recipient of personal data is Facebook, which, as the operator of the platform, processes the data as described in its data privacy information (https://www.facebook.com/about/privacy/).

KWS works with internal and external service providers (so-called processors), such as service providers for IT maintenance services. These service providers may only act in accordance with the instructions of KWS and are contractually obligated to comply with the applicable data protection requirements.

Insofar as legally permissible and necessary in order to comply with applicable law or assert, exercise, or defend legal claims, KWS forwards personal data to courts, authorities, and law firms.

We will not forward your personal data to countries outside the European Economic Area (“third countries”).

5. How long do we store your personal data?

For the purposes of carrying out our contests, the Facebook names of the participants are saved until the winner(s) are determined and are then erased. The names and address data of the winner(s) are saved until the prize is distributed, and then this data is deleted.

Otherwise, we will erase the data if it is no longer required for the purposes pursued by us and there are no other legal bases at play, in particular legal or contractual retention periods.

6. What rights do you have?

Within the context of the applicable legal provisions, you have certain rights related to your personal data. Please note that there are certain exceptions to the exercising of these rights, and you therefore cannot exercise them in all cases.

  • Information: You have the right to obtain information about all personal data stored by KWS about you.
  • Correction: You can demand that we change incorrect personal data.
  • Erasure: You can ask us to erase personal data under certain circumstances, and we will take appropriate steps to inform other controllers who process the data that you have requested the erasure of links to your data, copies of your data, and duplications of your data.
  • Revocation of consent: You can revoke your consent to the data processing that you have granted us and prevent further processing if there is no other reason why KWS can or must process your personal data.
  • Restriction: In certain cases, you can request that we restrict the processing of your data.
  • Portability: If you have provided us with data on the basis of a contract or consent, you can request receipt of the data provided by you in a structured, common, and machine-readable format or that we send it to another controller.

Right to object

For reasons arising from your unique situation, you have the right at any time to object to the processing of your personal data that is based on justified interests. This personal data will then no longer be processed for these purposes unless mandatory protectable reasons for the processing are established that outweigh your interests, rights, and liberties, or the processing serves to assert, exercise, or defend legal claims.

Right to object to processing of data for direct advertising purposes

In individual cases, your data is processed to conduct direct advertising. You have the right to object at any time to the processing of your personal data for the purposes of such advertising. If you object to the processing for direct advertising purposes, your personal data will no longer be processed for these purposes.
