Protection of your data in lotteries

We, KWS SAAT SE & Co. KGaA, Grimsehlstrasse 31, 37574 Einbeck and KWS LOCHOW GmbH, Ferdinand-von-Lochow-Strasse 5, 29303 Bergen (hereafter also referred to as "KWS" , "we" or "us") organize lotteries from time to time, primarily for farmers. If you take part in these lotteries, you will provide us with personal data. In this privacy notice, we inform you about how we process this data.

1. What personal data do we process in the context of lotteries?

For our lotteries we regularly process the names and postal addresses of participants. We must process this data, because without using the data we would not be able to determine the winners and hand over the prizes. We also regularly ask the participants whether they are interested in our e-mail service, which we use to inform them about our products and send them tailored information. For this purpose, we ask for the e-mail address, but the provision of this information is voluntary. In some lotteries, we may also ask participants to send us photographs or video recordings.

2. For what purpose do we process the data?

We process your data primarily to determine the winners of the lotteries and to hand out the prizes. We also process your data to send you information about KWS and its products by post, and if you have given us your consent, also by e-mail. We may use photographs and video recordings to process them within KWS or externally (e.g. on our social media channels).

3. On what legal basis do we process your data?

The legal basis for the processing of your personal data is Article 6 (1) (f) of the EU General Data Protection Regulation (GDPR). Our legitimate interests are to determine the winners of the lotteries and to hand out the corresponding prizes, as well as to advertise our services to persons interested in KWS products. If we process image and video material on the basis of a declaration of consent submitted by you, this is done on the basis of Art. 6 (1) (a) GDPR. If we send you information about KWS and its products by e-mail, this is also done on the basis of Art. 6 (1) (a) GDPR.

4. Do we pass on your data to third parties? Who is the recipient of your data?

We work together with internal and external service providers (so-called contractors), such as service providers for IT maintenance services. These service providers may only act in accordance with our instructions and are contractually obliged to comply with the applicable data protection requirements.

We may share photographs and video recordings with the operators of our common social media channels if we have received your consent in this regard. You can see the recipients of your photographs and video recordings in the consent form you have given.

To the extent legally permissible and necessary to comply with applicable law or to assert, exercise or defend legal claims, we will disclose your personal data to courts, authorities, or law firms.

The operators of the social media channels described in this section may be located in countries outside the European Economic Area ("third countries") where the applicable law does not grant the same level of data protection. 5. How long do we store your data?

If you participate in a KWS lottery, we assume that you are interested in our services and products. We therefore retain your data until you inform us that you want us to delete your data or until the data is no longer required for the purpose we are pursuing. In the event of a request for deletion, we will delete your data immediately, unless KWS must store your data for a longer period of time for any other reason (e.g. due to another business contact).

6. What rights do you have?

Within the scope of the respective legal requirements, you have certain rights regarding your personal data. Please note that certain exceptions apply to the exercise of these rights and that you may therefore not exercise them in all cases.

  • Information: You have the right to receive all personal data processed about you by KWS.
  • Correction: You can demand that we change incorrect personal data.
  • Deletion: You may request us to delete personal data in certain circumstances and we will take reasonable steps to inform other data controllers that you have requested the deletion of links to your data, copies or reproductions of your data.
  • Revocation of consent: You can revoke your consent to data processing that you have given us and prevent further processing if there is no other reason for KWS to process your personal data.
  • Restriction: In certain cases, you can request that we restrict the processing of your data.
  • Portability: If you have provided us with data on the basis of a contract or consent, you may request that you receive the data you have provided in a structured, common and machine-readable format or that we transfer it to another controller.

For reasons arising from your unique situation, you have the right at any time to object to the processing of your personal data that is based on justified interests. This personal data will then no longer be processed for these purposes unless compelling legitimate grounds for the processing are established that outweigh your interests, rights, and liberties, or the processing serves to assert, exercise, or defend legal claims.

Right to object to the processing of data for direct marketing purposes

In individual cases, your data will be processed to carry out direct advertising. You have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising. If you object to processing for the purposes of direct marketing, your personal data will no longer be processed for those purposes.
